What if a client says their employer doesn’t want them to make a WSIB claim?

General Rule: If your client is eligible to make a WSIB claim, and their employer tries to talk them out of it, explain to your client that it’s important that they still make a claim. Employers might try to offer additional wages or sick pay instead, but making a claim is important in case your client’s injury gets worse in the future or if they have medical expenses or additional costs.

How You Can Help:

  • Step 1: Explain to your client the importance of making a WSIB claim and encourage them to submit it online
    • Note: If your client is being paid in cash, they should seek legal advice immediately. Making a report to WSIB can have other consequences, and they should speak with a legal service provider before taking any steps.   • Step 2: Help your client make notes of their interactions with their employer. This should include things like what happened, whom they spoke to, what was said and when. These types of notes can help later on during a claim and can be very important.
