Can someone face discrimination when renting housing due to justice involvement?

General Rule: There is nothing which permits or forbids a landlord from requesting a criminal record check from a prospective tenant or from asking about someone’s criminal history.

If your client has applied for social housing, they might also face issues accessing social housing or rent-geared-to-income housing subsidies due to their justice involvement. Some social housing providers might refuse housing units to someone who was previously evicted from social housing for an illegal act. For more information, see: “What if a justice-involved individual wants to access social housing?”

How You Can Help:

If your client is facing discrimination due to a criminal record or justice involvement, help them source other housing options in the area.
